1. Agreement to Terms

By accessing or using Moniturl ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Moniturl provides automated monitoring services for:

• Affiliate links and website URLs
• Website scripts and third-party integrations
• Automated health checks and change detection
• Email and webhook notifications

The Service is provided on a subscription basis with different plan tiers (Free, Pro, Agency, Enterprise).

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and complete registration information

4. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Monitor websites or links you do not own or have permission to monitor
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to send spam or unsolicited communications
• Overload our systems with excessive requests (rate limiting applies)
• Reverse engineer, decompile, or hack the Service
• Resell or redistribute the Service without written permission

5. Plan Limits and Fair Use

Each subscription plan has defined limits:

• Free: 3 links, 1 site, daily checks
• Pro: 35 links, 5 sites, hourly checks
• Agency: 200 links, 20 sites, hourly checks
• Enterprise: Custom — unlimited links and sites, hourly checks, custom terms

We reserve the right to enforce fair use policies and may suspend accounts that abuse the Service or exceed reasonable usage patterns.

6. Payment and Billing

Paid subscriptions are billed monthly or annually in advance. By providing payment information, you authorize us to charge your payment method for all fees.

• Prices are in USD unless otherwise stated
• Payments are processed securely through Stripe
• Subscriptions auto-renew unless cancelled
• No refunds for partial months or unused service
• We may change pricing with 30 days notice

7. Cancellation and Termination

You may cancel your subscription at any time through your account settings. Cancellations are effective at the end of the current billing period.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in that policy.

You retain ownership of your data. We store check results and monitoring data to provide the Service. You can export or delete your data at any time.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance, upgrades, or emergencies.

We are not responsible for:

• Third-party service outages (hosting, payment processors, etc.)
• Network connectivity issues beyond our control
• Accuracy of monitored websites or their availability

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONITURL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
